Patient Services Agreement

This Patient Services Agreement ("Agreement") is entered into between you ("Patient") and MyPeptide, LLC, doing business as MyPeptide ("Company," "we," "us"), and governs your use of our telehealth consultation platform, peptide therapies, wellness products, and related services (collectively, the "Services").

By creating an account, completing an intake form, or purchasing any product or service through our platform, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.

Our platform connects you with licensed healthcare clinicians ("Providers") who may evaluate your health history, symptoms, and goals through asynchronous or synchronous telehealth consultations.

• Consultations are conducted remotely via our secure platform.
• Providers exercise independent medical judgment and may approve, modify, or deny any treatment request.
• Telehealth has limitations—emergency situations require calling 911 or visiting an emergency room.
• Our Services do not replace your primary care physician or specialist relationships.

You agree to:

• Provide accurate, complete, and current health information during intake and consultations.
• Disclose all medications, supplements, allergies, and pre-existing conditions.
• Follow prescribed treatment protocols and report any adverse reactions promptly.
• Use products only as directed by your assigned Provider.
• Not share, transfer, or resell any prescribed medications or products.
• Maintain the confidentiality of your account credentials.

Products available through our platform, including peptide therapies, are dispensed by licensed compounding pharmacies or authorized suppliers. All products require a valid prescription or Provider authorization.

• Products are for personal use only and are non-transferable.
• Storage and handling instructions must be followed as directed.
• Results may vary; no specific outcomes are guaranteed.
• Certain products may have contraindications—your Provider will review these with you.

Certain Services require an active membership subscription. By subscribing, you authorize recurring charges to your payment method at the applicable rate.

• Membership fees are billed in advance on a recurring basis (monthly or annually as selected).
• You may cancel your membership at any time; cancellation takes effect at the end of the current billing period.
• Refunds for unused portions of a billing period are not provided unless required by law.
• Product orders are charged separately and are subject to the refund policy in Section 6.

• Consultation fees are non-refundable once a Provider has reviewed your case.
• Product orders may be cancelled before shipment for a full refund.
• Shipped products may be returned within 14 days of delivery if unopened and in original packaging.
• Custom-compounded products cannot be returned due to safety regulations.
• Membership cancellations do not trigger refunds for the current billing cycle.

We take your privacy seriously. Your personal health information ("PHI") is handled in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and applicable state laws.

• PHI is encrypted in transit and at rest using industry-standard protocols.
• We do not sell or share your PHI with third parties except as required to provide Services or as required by law.
• You may request access to, correction of, or deletion of your records by contacting support.
• A separate HIPAA Notice of Privacy Practices is available for your review.

By proceeding with any treatment or product prescribed through our platform, you acknowledge and consent to the following:

• All medical treatments carry inherent risks, including but not limited to side effects, allergic reactions, and unforeseen complications.
• Peptide therapies are an evolving area of medicine; long-term effects may not be fully established.
• You have had the opportunity to ask questions and have received satisfactory answers from your Provider.
• You voluntarily consent to the recommended treatment plan.

To the maximum extent permitted by law, the Company, its officers, employees, clinicians, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services.

Our total aggregate liability for any claims arising from this Agreement shall not exceed the amount you paid to the Company in the twelve (12) months preceding the claim.

Any disputes arising under this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in the state where the Company maintains its principal place of business. Each party shall bear its own costs and attorney fees unless the arbitrator determines otherwise.

We reserve the right to update or modify this Agreement at any time. Material changes will be communicated via email or through a notice on our platform. Your continued use of the Services after such notice constitutes acceptance of the modified terms.

This Agreement shall be governed by and construed in accordance with the laws of the State in which the Company is incorporated, without regard to its conflict of laws provisions.
